About Michael Kilbane
Michael was admitted as a solicitor in 2003 and he is a partner in the Dispute Resolution team.
Michael’s training and early practice years were invaluable in providing him with a solid grounding in litigation, dealing with a variety of contractual and property disputes. As a junior lawyer he had the memorable experience of assisting with a case that progressed to the Court of Appeal.
At a later firm providing legal services to a stock exchange listed property-based plc, Michael gained considerable practice of applications within the jurisdiction of the First-tier Tribunal (Property Chamber) including: service charge disputes, dispensation from statutory leasehold consultation; and determinations for breach of covenants.
The last ten years of Michael’s practice has focused on maintaining a commercial and residential property dispute practice as well as professional negligence claims, contentious probate claims including applications for removal of executors and Trusts of Land and Appointment of Trustees Act 1996 claims. Following recent qualification as a civil mediator, Michael is also developing a mediation practice.

- Hackney Council & Berkeley Homes v Powlesland & 6 others [2020] EWHC 2102 (Ch) (The Happy Man Tree case)
- In Inheritance Act claims, Michael negotiated: a money and property settlement worth £1.5 million for the second wife of a very short marriage; a settlement, in an out-of-time claim, whereby a vulnerable party received the lion share of his late partner’s estate ensuring housing and subsistence needs were met for life; and a settlement in High Court proceedings involving an elderly partner and de facto wife, who faced eviction from her home.
