About Bhaskar Banerjee

Bhaskar Banerjee specialises in civil liberties and human rights and has dedicated his career to bringing claims against the police and other state bodies for false imprisonment, assault and battery, breaches of the Equality Act 2010, breaches of the Human Rights Act 1998, trespass to property and to goods, misfeasance in public office and for malicious prosecution. He also has significant experience of acting for bereaved families in inquests following deaths in police and prison custody as well as in deaths in mental health settings.

Bhaskar worked on several high profile reported cases prior to joining the team, including the case of Reynolds v Chief Constable of Kent Police [2024] EWHC 2487 (KB) where his legal team successfully argued that a claim for false imprisonment cannot be struck out under the law of fundamental dishonesty and overturned a lower court’s decision doing the same, and the case of R (oao Ginn) v HM Senior Coroner for Inner London [2022] EWHC 28 (Admin) where his team successfully quashed an inquest verdict on the basis that the directions to the jury in the initial inquest had not been sufficiently clear to enable the jury to reach conclusions on central issues that contributed to the death. The case is now referred to in Coroner’s guidance regarding directions to the jury.

 

Bhaskar has a growing interest in protest law. He feels strongly about the recent legislative and political encroachment on this fundamental right and has successfully secured awards of compensation on behalf of protesters for false imprisonment, assault and battery and unlawful interference with freedom of assembly and expression by the police.
