The right to protest is a fundamental part of democracy. The Human Rights Act 1998 guarantees the right to freedom of assembly (or freedom of association) and the right to freedom of expression. There are also common law and statutory constraints on police powers in protest situations.

Hodge Jones & Allen is one of the leading law firms in the UK specialising in defending the right to protest (Chambers & Partners, 2016). Our passionate and committed Civil Liberties team – who work closely with our renowned Public Order/Criminal law team – have extensive experience in bringing and winning difficult, controversial and high profile cases. We’re dedicated to defending the right to protest against injustice.

Recent cases

Our cases in recent years include:

  • G20 protests
  • Anti-fascist marches
  • UK Uncut protests
  • Critical Mass events
  • Arms fairs
  • Traveller site evictions (Dale Farm)
  • Immigration detention centre protests
  • TUC events

We’ve been highly successful in obtaining apologies, compensation and changes to police practice through disciplinary and civil actions against the police.

Many of our lawyers have been involved in campaigning themselves – on green issues, on anti-racism, or against public sector cuts. Most importantly, we treasure and value the right to free speech and ensure that our lawyers fight for that right.

Protest Law

Hodge Jones & Allen represented three protesters who were arrested whilst taking part in a counter-demonstration against a rally by the British National Party outside of the Houses of Parliament on 1 June 2013. The police placed conditions on the counter-demonstration and arrested the claimants for breach of these conditions. Two of the claimants were prosecuted and the third sustained serious injuries. There were questions over whether the conditions were lawful and/or properly communicated to those attending the demonstration. All three have received damages from the defendant.
