The right to protest is a fundamental part of democracy. The Human Rights Act 1998 guarantees the right to freedom of assembly (or freedom of association) and the right to freedom of expression. There are also common law and statutory constraints on police powers in protest situations.

Hodge Jones & Allen Solicitors is one of the leading law firms in the UK specialising in defending the right to protest (Chambers & Partners, 2016). Our passionate and committed Civil Liberties team – who work closely with our renowned Public Order/Criminal law team – have extensive experience in bringing and winning difficult, controversial and high profile cases. We’re dedicated to defending the right to protest against injustice.

Recent cases

Our cases in recent years include:

  • G20 protests
  • Anti-fascist marches
  • UK Uncut protests
  • Critical Mass events
  • Arms fairs
  • Traveller site evictions (Dale Farm)
  • Immigration detention centre protests
  • TUC events

We’ve been highly successful in obtaining apologies, compensation and changes to police practice through disciplinary and civil actions against the police.

Many of our lawyers have been involved in campaigning themselves – on green issues, on anti-racism, or against public sector cuts. Most importantly, we treasure and value the right to free speech and ensure that our lawyers fight for that right.

How do I make a claim for compensation?

There are different deadlines for different causes of action, for example, civil claims for compensation due to a breach of human rights must be issued at court within 1 year. The sooner you contact us, the better. It is important evidence is collected quickly and recorded. However, if you think you might be out of time, don’t let this stop you from calling us – we will advise you if this is a problem, and if we can take your case on, we will fight to get your claim heard however long ago it was.
