Careless/Dangerous Driving

Careless and dangerous driving covers a multitude of driving misdemeanours.

Careless Driving

You can be charged with careless driving for passing through a red traffic light, overtaking on the inside, using a mobile phone, lighting a cigarette or even taking your eye off the road for a moment while you tune the car radio or talk to a passenger.

You can be convicted of careless driving, whether or not your actions were deliberate or the result of momentary distraction or inexperience, even if it didn’t result in an accident.

Careless driving carries severe penalties including:

  • a fine of up to £5000
  • three to nine penalty points
  • disqualification

If a careless driving incident leads to a fatal accident it can then escalate to a new offence: ‘causing death by careless driving’. This carries a maximum sentence of 5 years in prison. Whatever your circumstances and however serious the situation, it is vital that you get the right advice as early as possible.

Dangerous Driving

Dangerous driving and causing death by dangerous driving are serious driving offences which carry a substantial risk of a prison sentence or instant disqualification.

To be guilty of dangerous driving you must have driven in a way that falls far below the standard of a competent and careful driver. Examples of this include driving at excessively high speeds; racing; overtaking dangerously; ignoring road traffic signs and driving a vehicle which is not roadworthy.

We understand that often there are often circumstances which may cause a driver to appear to act recklessly or which may have led to an accident. We will look at all aspects of the incident. It may be that your driving wasn’t great, but neither was it dangerous. We will defend you fully, or at the least reduce the severity of the penalty imposed.

Speeding

Speeding offences are treated seriously. If you are caught driving over the speed limit then there is a danger of immediate disqualification. Drive at more than 40% over the speed limit and this risk becomes very high indeed.

The penalty can be disqualification for between seven and 90 days’. In addition you can receive between three and six points on your licence and a fine of up to £2,500. Depending on your situation we can help you find an appropriate defence. This might involve challenging the accuracy of the speed recording devices or the procedures that were followed. We can also present the special circumstances of your case which can persuade the court not to disqualify you.
