Data Protection and Privacy Rights

Our personal records are very important to us as they record and map out our lives. The Data Protection Act 1998 (DPA) regulates the processing of information relating to individuals. Misuse of our private information often causes distress and requires urgent action.

Your confidentiality and privacy is a fundamental human right

The Human Rights Act was introduced in 1998 and overtime a further element has developed under Article 8 of the European Convention of Human Rights – the right to respect for an individual’s private and family life, his/her home and correspondence.

The law protects people’s right to privacy in a number of ways

At Hodge Jones and Allen our specialist team of solicitors act for individuals in situations where bodies (including hospitals, local councils, businesses, clinics) have inappropriately released personal information without consent being given (breach of confidence).

Our civil liberties team also represent individuals and campaigning groups in relation to requests for official information, made under the Freedom of Information Act and/or the Environmental Information Regulations, held by public authorities.

Our expertise covers key areas of the law, including:

  • Freedom of Information Act 2000
  • Data Protection Act 1998
  • Articles 8 and 10 of the European Convention on Human Rights
  • Surveillance – Regulation of Investigatory Powers Act 2000

Under the Data Protection Act, everyone responsible for using data has to follow strict rules called ‘data protection principles’ these include making sure your information is:

  • Accurate
  • Used fairly and lawfully
  • Used for limited, specifically stated purposes
  • Kept for no longer than is absolutely necessary
  • Kept safe and insecure
  • Not transferred without adequate protection

If you believe your information regarding your personal details, medical records have been shared without your consent, our specialist team are available to have an initial confidential chat.
