Fatalities Caused by Negligence

If a loved one has been killed in an accident, we understand that you will be suffering with immense grief and stress. Such grief is often made worse when the incident that led to the death was caused by the negligence of another person.

We understand that the last thing you’re thinking about when somebody close to you dies is making a claim. However, you may also be worried about how you will cope financially because losing a family member can have a massive impact on the household finances.

WHAT CAN I CLAIM FOR?

If someone else was at fault in causing the accident, we could help you to claim compensation to ensure that you and your family don’t suffer any unnecessary financial hardship. This will also provide critical security for the future during your recovery process.
When you are ready, you may wish to consider pursuing a claim for compensation against the organisation or person who caused the accident. We understand that nothing will ever make up for your tragic loss. However a successful claim may go some way to helping you and your family cope with the grief and stress that you have suffered.

We have in-depth experience in handling fatal injury claims and have helped many families make claims following the death of a loved one. Our caring, sensitive solicitors will be able to provide you with the sympathetic and professional legal assistance that you’ll need during this difficult time.

HOW MUCH CAN I CLAIM?

As every fatal injury occurs with different circumstances, the amount of compensation you could potentially claim as part of a fatal accident claim will be different from what others might receive.

As a guide, compensation given will be calculated according to several different factors, which include:

  • Actual losses – these are intended to cover costs incurred whilst caring for the injured person prior to their death, as well as expenses such as funeral costs. If the fatality was delayed, the compensation received may also cover actual loss of earnings and anything related to care, such as medical fees.
  • Bereavement – under the Fatal Accidents Act 1976, the spouse of a deceased person or parents of a deceased child are eligible for a lump sum payment of £12,980 following a fatal accident.
  • Dependency – the remainder of any compensation that may be awarded will be paid to any dependents who relied upon the income of the deceased person.

Why should you consider making a fatal accident claim?

If the death of a loved has caused you financial hardship, a fatal accident claim would help ease this problem. A claim would also cover funeral expenses and would help secure the family’s future financial needs.

WHO CAN MAKE A CLAIM?

There are three main groups of people who are entitled to claim fatal injury compensation following the death of an individual. These are the dependents of the deceased, close relatives of the deceased, and the deceased’s estate.
