Andrew is a young man who was riding his bike when he was hit by a car. He suffered a severe brain injury and has now been diagnosed with depression and anxiety as a result of his injury. He is also unable to sleep for long periods of time and finds it difficult to engage in everyday activities.
Our Personal injury team assisted in making a claim against the insurers of the driver responsible for the accident. Andrew was assessed as having capacity to deal with his everyday spending, but not capacity to weigh up how best to deal with his settlement award. As a result of his injury, Andrew is also prone to making impulsive financial decisions without thought as to how this will affect him in the long term.
Philippa Barton was appointed to act as Andrew’s Deputy and soon after Andrew received a settlement of £1.6 million from the insurers. With part of the settlement money, the Deputy purchased a property on Andrew’s behalf.
As Deputy, we were able to ensure that Andrew received all of the benefits that he was entitled to, and take independent financial advice on how to invest the settlement. Andrew receives his benefits directly into his personal bank account and we arrange for a monthly sum to be sent to him to supplement this. For the most part, Andrew is able to budget his everyday spending from these sources. Andrew is also keen to be kept up to date with his investments and we meet with him and his financial advisor twice a year to ensure that he is aware of the investments that are being made on his behalf.
