What is asbestos exposure?
Asbestos is an insulation material which was widely used in construction for many decades, particularly between the 1960s and 1980s. Asbestos use in the UK was completely banned in 1999. When asbestos is disturbed through maintenance, repairs or general wear, it releases hazardous dust particles.
Inhaling these dust particles can cause permanent, sometimes fatal, damage to the lungs and respiratory system. Exposure is a proven cause of several serious conditions, including:
- Mesothelioma
- Lung cancer
- Asbestosis
- Pleural thickening
These asbestos-related diseases affect the lives of thousands of people and their loved ones every year.
According to statistics from the HSE for 2025 (reported by UKATA) asbestos-related diseases cause around 5,000 deaths per year in the UK. This figure includes mesothelioma, lung cancer and asbestosis. The deaths relate to historic asbestos exposure but as the diseases do not usually develop until many decades later, it is today that the health of those exposed is being affected.
If you have been diagnosed with an asbestos-related disease, you should seek guidance from an asbestos compensation solicitor about making a claim.
Understanding asbestos exposure and securing compensation
The health risks associated with asbestos have been known for many years, yet many employers failed to protect their workers before the 1999 ban. By the time the asbestos ban came into effect, it was far too late for those who suffered exposure decades earlier.
Many associate the risks of asbestos with the construction industry, but the reality is that exposure has extended to people from all walks of life.
Identifying where and when the exposure took place is the most important step in making a compensation claim. Our team of expert asbestos solicitors at Hodge Jones & Allen specialise in these complex investigations, leaving no stone unturned to hold the accountable parties responsible.
What is mesothelioma?
Mesothelioma is a type of cancer that develops in the lining of certain organs. It commonly affects the lungs (pleural mesothelioma) but can also develop in the lining of the abdomen (peritoneal mesothelioma), heart (pericardial mesothelioma) or testes (testicular mesothelioma).
The primary cause of this is the inhalation of asbestos dust, which becomes lodged in the lungs or other organs and develops into one of the forms of mesothelioma.
Our mesothelioma lawyers understand that a diagnosis can significantly impact you and your family. If you’ve been diagnosed with mesothelioma or any asbestos-related disease, contact us to discuss the options to secure the help you need to support your care and future.
What are the symptoms of mesothelioma?
The symptoms of mesothelioma can include the following:
- Shortness of breath
- Tiredness
- Chest pain
- Persistent cough
- Sweating and high temperatures
- Weight loss
- Loss of appetite
- Difficulty in swallowing
- Pain or swelling in the abdomen
- Feeling sick
- Diarrhoea or constipation
Am I eligible to make an asbestos compensation claim?
If you or a loved one have any of the following conditions, it may be possible to claim compensation:
- Mesothelioma
- Asbestos-related lung cancer
- Asbestosis
- Pleural thickening
- Pleural plaques (claims can only be pursued in very limited circumstances).
How does exposure occur?
While most asbestos conditions result from exposure to asbestos materials at work, we also support claims from clients with secondary or environmental exposure, including:
- Handling contaminated work clothes brought home by a family member who worked with asbestos materials
- Living close to an asbestos factory
- Use of talcum powder or make-up products containing asbestos particles
If any of these scenarios apply to you or if you are experiencing the effects of an asbestos-related condition, contact our specialist asbestos claim solicitors who will be able to advise you further.

How do I make a mesothelioma and asbestos compensation claim?
We aim to make claiming as straightforward as possible for you and your loved ones. When you contact our asbestos compensation lawyers, we follow a clear process:
1. Initial consultation: We start by discussing your diagnosis and your work history, as well as other potential sources of exposure to asbestos dust, to understand when and where the exposure occurred. If we think you have a case, we will let you know and explain the next steps.
2. Evidence gathering: We look at your employment history in detail to track down the companies (or their insurers) responsible for exposing you to asbestos decades ago. If the exposure to asbestos took place outside of your employment, we will gather the necessary evidence.
3. Medical assessment: We arrange for medical experts to provide reports that link your condition to your – or your loved one’s – asbestos exposure, ensuring we have the evidence needed for a strong claim. In most cases, it is not necessary for a face-to-face medical examination to take place.
4. Negotiation and litigation: We put forward the evidence with a view to getting you the maximum compensation. This includes not only monetary settlements but also assistance in accessing any medical treatments you might need which are not available on the NHS.
5. Settlement: Once we’ve finalised negotiations, either with a negotiated settlement or through the courts, you’ll receive your compensation. We never deduct anything from your compensation for legal costs or expenses.
Along with successfully claiming compensation, we work closely with advisors and support groups who can help you manage the practicalities of a diagnosis, such as arranging specialist home adaptations and accessing emotional support.
"I would like to thank you for all your hard work that you have put into this claim. I know there have been obstacles and it has not been easy. However, you have left no stone unturned and continued to fight this case despite the difficulties. I would certainly recommend you and your company to fight any claims relating to mesothelioma. Your service has been first class and handled with such professionalism." Client J.C

No win, no fee

This way, you can focus on rebuilding your life without worrying about costs.
How was Asbestos used?
Asbestos was widely used in construction from the 1900s. It was installed extensively as fireproofing and insulation throughout the 1960s, 70s and 80s and can still be found in some buildings from those eras.
Find out how to identify asbestos use.
How much will it cost me to pursue a claim?
Our work is funded through a conditional fee agreement, which is often known as a no win, no fee arrangement. This means you can make a claim without any financial risk. If the asbestos-related claim is successful, we do not deduct anything from your compensation for legal costs or expenses whereas some other law firms do make deductions from compensation for legal costs or expenses incurred.
How long will my claim take?
Every claim is different, so it can be hard to say how long it might take to get an outcome. It will all depend on the nature of the claim. Our team will be able to explain the procedure and how long the process is likely to take when you get in touch for a consultation. We will always aim to pursue your case as quickly as possible.
What is the time limit to make an asbestos or mesothelioma claim?
The law normally requires that court proceedings must be started within three years of when you are first told that you have an asbestos-related disease, or within three years of the date the person concerned has passed away (as long as they did not know of the condition themselves for any longer than three years before their death). With this in mind, it’s important that you get in touch as soon as possible to start your compensation claim.
There are some exceptions to this general three-year rule, so if you are past the time limit, please do still get in touch to discuss this with our team of asbestos solicitors.
How much compensation could I be entitled to for mesothelioma?
The compensation amount you receive varies from case to case and depends on several factors, including:
- The severity of the illness and the impact on your life
- Financial losses incurred to date
- Financial losses likely to be incurred in the future
Our mesothelioma lawyers will let you know how much you can expect to receive in compensation as you continue through the claims process.
Can I still claim if my employer no longer exists?
Yes, a compensation claim can still be brought, as long as the employer’s liability insurer can be traced. Our mesothelioma lawyers are well experienced in the steps needed to try and identify the relevant insurers.
Even if the insurers cannot be traced in a mesothelioma claim caused by previous employment, all is not lost. An application can still be made to a government scheme to obtain compensation for mesothelioma. We will advise you on your options when we examine the details of your case.
I already have a solicitor acting for me. Can I transfer to another?
Yes. You are free to instruct any solicitor of your choice and so transferring your claim shouldn’t present a problem. Any costs that may be due to your current solicitor can usually be put on hold and recovered at the end of the case if it is successful, along with any fees for your new solicitor.
What happens to my claim if I pass away before the case is finished?
The claim can continue in the event of your death. In some asbestos-related claims, the person has unfortunately already passed away before our solicitors are instructed. In these fatal cases, claims can be pursued by the Executor of the person’s estate, on behalf of the estate and any dependants.
