The London Legal Podcast Episode 5: Whiplash Reforms – Navigating The Claims Process

The latest episode of The London Legal Podcast is now online. In this episode, Leticia Williams and Karen Mann of our Personal Injury team discuss the upcoming whiplash reforms, which are set to be implemented on 31st May 2021.

The aim of the whiplash reforms is to make it harder for people to claim compensation for exaggerated or fraudulent whiplash claims. However, this essentially means that anyone injured in a Road Traffic Accident will not be able to instruct a solicitor if their claim is worth £5,000 or less, as insurers will no longer meet the legal costs of claims of this amount.

Time is quickly running out to make a compensation claim for whiplash injuries with an expert solicitor by your side. Navigating the claims process can be incredibly difficult without specialist assistance and advice, meaning the reforms will restrict access to justice. Whiplash claims will no longer be accepted without medical evidence, so it’s likely that injured people will have to:

  • Submit their claim using an online portal.
  • Instruct their own medical expert to diagnose their injuries
  • Pay £180 up front for a medical report if the other side denies liability
  • Accept reject or possibly appeal the compensation offer the other side put forward.
