Supreme Court allows appeal and quashes Westminster City Council’s decision on out of borough placement
There was welcome news this week for homeless applicants across the country with the news that the Supreme Court has quashed Westminster Council’s decision on an out of borough placement to Milton Keynes. Our client argued that Westminster Council failed to examine all the available housing in the borough or available nearer to the authority’s district when they made their decision and therefore, it was unlawful.
The importance of the case was recognised by the fact that the Supreme Court communicated their decision the following day after the hearing on 17 March 2015. The reasons for the decision will be announced by the Supreme Court when judgment is handed down, which is expected to be after Easter.
Mr Jayesh Kunwardia, Partner at Hodge Jones & Allen and instructing solicitor on this case, states the judgment is keenly awaited and will be one of the most important social housing judgments for decades, setting a precedent for homelessness applicants across the country.
