What is Artificial Intelligence?

Artificial intelligence is technology which allows computers to simulate human learning, comprehension, problem solving, decision making, creativity and autonomy.

Recent breakthroughs and proliferation of generative AI platforms such as Chat GPT, Google’s Gemini and Meta AI, to name a few, have made doing previously complex tasks and knowledge more accessible than ever before.

So, you might think, given all these developments, it would be a useful case-preparation tool for you to use.

Here is why generative AI is not such a useful tool:

1. Data Privacy Issues

To put it simply, the way generative AI works is that it uses large amounts of material to improve processes and learn how to do complex tasks. Therefore, any data you input into AI chatbots is kept and used by AI to learn. This means that potentially case-sensitive, personal details are no longer confidential because it has been put through several layers of learning models.

If the systems are compromised, confidential information about you and your case could be leaked and at best affect your right to a fair trial, at worst, leak your personal or case details.

2. Bias

Because of the way generative AI learns from data inputted, it means that it lacks vital context and finds it difficult to differentiate between fact and opinion. Generative AI suffers from confirmation bias, and this can lead it to give false credibility to unproven facts.

The more you discuss your cases and opinions with AI chatbots, the more it will validate your opinions without offering an objective, legally sound perspective.

3. Misinformation/Hallucinations

By far the biggest issue we have seen with generative AI is the copious amounts of misinformation which has populated social media platforms.

AI can create deepfakes, which are images or videos which look and sound extremely realistic, however, they are not. Some deepfakes are extremely difficult to tell from real photos or videos.

In legal settings, AI has been known to invent case law with many lawyers receiving sanctions for using fake citations and using AI generated cases in court.
