Accidents caused by the negligence of others can and do occur in all workplaces, including offices. You should also be able to safely visit other workplaces and leave uninjured. If unfortunately you have been injured whilst working in, or visiting offices, you may be able to bring a claim under the Occupiers Liability Act 1957.
An occupier of a premises is the person or company that is responsible for those premises in law. The occupier can be liable for injuries that occur to visitors whether this is an office, shop, or car park.
The law states that an occupier must ensure that any visitor is ‘reasonably safe in using the premises for the purposes for which he is invited or permitted by the occupier to be there’. Sometimes, even if the occupier has provided a warning to a visitor about a potential danger, which subsequently causes an accident, they may still be liable in law.
You may also have a personal injury claim even if you were trespassing on the premises or land due to the Occupiers Liability Act 1984.
The most common accidents at work are tripping and slipping but other accidents can include falling or injuries caused by faulty or defective parts of the premises or equipment that is on the premises.
There are also less obvious accidents and situations that you can potentially claim for, such as unsuitable office furniture that may cause damage to an employee’s back, or a keyboard that does not provide the required wrist support can impact the employee and possibly result in a potential claim for compensation.
As every injury is personal, the amount you could receive will be personal to you. However, to gain an initial estimation on the amount of compensation you could be entitled to, you might find it helpful to try our Compensation Calculator.
If you suffer any type of injury at work, you should always seek immediate medical attention. Sometimes an injury may prevent you from working and you might also have expensive medical bills to pay as a result.
