Wrongful Birth Claims – Ultrasound Scans

The vast majority of antenatal care is expertly handled by the NHS or private hospitals but sometime things can go wrong.

Pregnant mothers have a number of checks during their pregnancy and the first contact with a midwife or a doctor should occur as soon as the mother finds out that she is pregnant. At this appointment the mother will be given advice on lifestyle issues and advised as to how the pregnancy will be managed. A history should be obtained of any possible genetic problems with the mother or father. At 8 to 12 weeks the mother will be offered a ‘booking appointment’.

Dating scan

At 8-14 weeks the mother will undergo an ultrasound scan to check when the baby is due to be born – this is called the dating scan.

20 week anomaly scan

A further ultrasound is performed at 18-20 weeks. This is an important scan and the purpose of this scan is to thoroughly check the developing baby and make sure that the mother and father are advised of any possible abnormalities. This is called the ‘anomaly scan’.

Antenatal scanning negligence

The ultrasound scans are performed by specialists called sonographers. They are very skilled at detecting any fetal abnormalities. However, sometimes errors do occur and the sonographer perhaps fails to detect serious orthopaedic or brain abnormalities.

The conditions that can be missed relate to missing limbs, missing structures of the brain or heart conditions. These problems should then be discussed with the parents so that important decisions can be made about the pregnancy.
