Claims Arising Out Of Death

When failings by state authorities lead to a person’s death their family deserves redress for their loss. Our Civil Liberties team has a distinguished and long-standing record of pursuing claims and Judicial Reviews against public bodies.

We have specialist expertise of legal challenges involving breaches of the European Convention on Human Rights (ECHR), for example where not enough has been done to protect the deceased’s life. We have been involved in some of the most important cases in this area, for example extending the protection of the ECHR to British soldiers on active service abroad.

In addition to claims for compensation we have experience of challenging Coroners’ decisions where inquests have failed to properly investigate a death.

State agencies such as the Ministry of Justice, the police, the Ministry of Defence and healthcare authorities all have their own legal representation in these cases, and we have the expertise and dedication to take them on and win.

We are committed to seeking justice for our clients and holding the authorities to account. Our sympathetic lawyers aim to be a source of support and clear guidance for bereaved families at a difficult time.

Recent cases

  • Following a lack of disclosure by the Ministry of Defence, we challenged the verdict of an inquest into the death of Private Jason Smith, who suffered fatal heatstroke while serving in Iraq in 2003. A second inquest found that opportunities to intervene in his deteriorating health were missed, and we won substantial damages for his mother.
  • We secured compensation for the family of Fiona Pilkington from Leicestershire Police. Fiona Pilkington made numerous reports to police regarding anti-social behaviour and the harassment that her family was faced from local youths but these were ignored. Tragically she set fire to the family car killing herself and her daughter when she was unable to take any further harassment.
  • We are currently instructed in claims arising out of deaths at Colnbrook and Harmonsworth Immigration Removal Centres. These claims relate to a failure to provide basic medical care to those who have died.

Our claims arising from death specialists are part of our London based death in custody team. We have almost four decades of experience helping clients from around the UK with a wide variety of legal matters. For expert legal advice use our contact form or call us on 0808 250 6017 today.
