Lasting Power of Attorney (LPA): This allows you to nominate someone to take care of your affairs and make decisions on your behalf if you become unable to do so.
Court of Protection and Deputyship: When a person loses mental capacity and cannot take care of themself or their affairs then the people nominated as having lasting power of attorney must apply to the court to register the LPA before they can carry out their duties.
However, if there isn't an LPA in place then a deputy needs to be appointed by the Court of Protection. The deputy is normally a close family member however a professional deputy can be appointed. A deputy can make decisions about financial affairs and decisions about health and welfare.
Statutory Wills: The court has the power to make a will on behalf of a person lacking capacity. We can help you make the application.
