Delay in receiving medical treatment for a prisoner

Personal Injury case report: Delay in receiving medical treatment for a prisoner

Our client suffered an injury to his foot. There was a dispute with regards to whether this was caused as a result of an assault upon our client or if was self inflicted.

In either event our client complained that he believed his foot to be broken and requested treatment.

Despite regular entries in the prison records that show requests for treatment there was a delay of 22 days before our client's foot was x-rayed and the fracture treated.

Fortunately, the delay in treatment has not caused any long term problems.

The Defendant offered the sum of £1,250 for the increased pain suffered as a result of the delay which our client accepted.
