We represented three clients who all suffered
salmonella food poisoning from ill prepared food at a family
birthday party.
The food had been prepared by outside
caterers. All three clients suffered from diarrhoea and vomiting,
varying in severity.
The initial symptoms were very severe and
lasted 2 to 3 weeks. Their continuing less severe symptoms lasted 3
to 4 months before all three clients had fully recovered.
Client 1
This client was unable to work for three
weeks. The client was paid his basic pay but lost his usual regular
overtime. Furthermore, when this client returned to work he was
unable to do his normal level of regular overtime for a few
months.
This client was awarded a global sum of
£3,000. This sum included damages for his sickness (general
damages) and loss of overtime and the cost of over the counter
medication (special damages).
Client 2
This client was unable to work for two and
half weeks. She was not paid during this time.
This client was awarded a global sum of
£2,250. This sum included damages for her sickness (general
damages) and loss of earnings, and the cost of over the counter
medication (special damages).
Client 3
Immediately after the birthday party this
client went on holiday to Tenerife. As a result of his sickness his
holiday was ruined.
This client was awarded a global sum of
£2,500.
This sum included damages for his sickness
(general damages) and the loss of enjoyment of his holiday, and the
cost of over the counter medication (special damages).
