sustained in cycling accident
Our client was cycling to work one morning
when a delivery van failed to give way and collided into her
causing her to fall. She landed on her bike and banged her face on
the road, sustaining cuts to her lips, chin and hands, fractures of
two teeth and damage to previously completed dental work. Our
client was left with a small facial scar. The police did not
prosecute the van driver, but gave a formal warning for the offence
of driving without due care and attention.
The motor insurers of the van driver accepted
liability. The claim ultimately settled before proceedings on the
basis of a payment of £4,000 for pain and suffering, plus the cost
of bike repairs and 50% of the cost of future dental treatment
which in total was a further £1,800. The case was funded by the
Claimant's own legal expenses insurance policy.
