Personal Injury case report: £3,000 awarded by Criminal Injuries Compensation Authority as a result of playground incident

Our Client, an 8-year-old boy, claiming through his Father, was allegedly stamped on in a playground by other children and had his leg broken.

An application was made to the Criminal Injuries Compensation Authority (CICA).

The CICA initially rejected the application on the grounds that our Client could not show that he was the victim of a crime of violence. There were no independent witnesses to the assault.

An application for review was submitted and it was successfully argued that the break to the leg was too severe to have been an accident. The break consisted of a complete break of the bone coupled with a further 3 inch piece of thighbone being snapped off.

Our Client made a good recovery and was left with no lasting symptoms. The CICA made an award of £3,000 for a "Fractured Femur with full recovery" on their tariff.
