Armed Forces Compensation (AFCS)

The Armed Forces Compensation Scheme (AFCS) is one of the alternatives to pursuing a civil claim through the courts. Compensation is generally received more quickly through this route than through the courts, however awards can be considerably lower.

Awards are usually made up of a lump sum, calculated using tariff system depending on the severity of the injury, coupled in more serious cases with a regular annual payment for life. The maximum lump sum payable under the scheme, for the most serious injuries, is currently £285,000, although in early 2008, then Secretary of State for Defence, Des Browne, announced in parliament that the government plans to increase this to £570,000 as part of a wider package to increase support for armed forces personnel and their families.

The Armed Forces Compensation Scheme is open to members of the armed forces who have suffered an injury as a result of military service after 6 April 2005. The Scheme operates on a ‘no fault’ basis and, contrary to a civil claim, it is not necessary to establish negligence or breach of health and safety regulations on the part of the MOD. An applicant to the Scheme is not prevented from pursuing a personal injury claim for compensation through the courts, and if successful, this latter route is more likely to lead to a higher award of damages. Any claim under Armed Forces Compensation Scheme must generally be brought within five years of whichever the earliest of the date the injury occurred, the date the condition was made worse by service, the date medical advice was first sought, or the date the injured person leaves the armed services.
