Homelessness - H v Council

Housing Law case report: Homelessness
Ms H applied as Homeless to the Council. The Council refused to accept a duty to house her because they considered her to be Intentionally Homeless from her previous accommodation.
Ms H had left her previous accommodation because it was in disrepair and her landlords had failed to take action to remedy the disrepair. We submitted detailed representations in support of Ms H’s review of the Council’s decision arguing, amongst other things, that she should not be considered Intentionally Homeless as her previous accommodation was not reasonable for her to continue to occupy. We were successful in the review of the Council’s decision and the Council subsequently made Ms H an offer of accommodation.
