Disrepair
Mr D brought proceedings against the Council for failing to keep
his property in repair. Mr D was diagnosed with very advanced HIV
and living in damp conditions was detrimental in terms of his
chronic lung disease.
The Council had failed to carry out effective repairs to the
property, resulting in a surveyor finding amongst other things that
the damp proof course in the property had failed.
The case was settled by a consent order requiring the Council to
pay Mr D £10,500 in damages and his costs.
There was also provision made in the order for the Council to
carry out repairs which the surveyor had identified including an
order for Mr D to be provided alternative suitable accommodation
during the course of the repairs.
