Homelessness and Domestic Violence

Ms A fled her matrimonial home with her children because of domestic violence from her husband.

She applied as homeless to the Council. The Council refused to accept a duty to house her because they did not consider her to be homeless; they said she was not at risk of domestic violence in the matrimonial home and she could return.

We requested a review of the Council’s decision.

The Council refused to accommodate Ms A pending the outcome of the review and we obtained a court order compelling the Council to accommodate her.

We were successful in the review of the Council’s decision and the Council subsequently located a new accommodation for Ms A and her children.
