What is a Prenuptial Agreement?

A prenuptial agreement, commonly abbreviated to 'prenup' or 'prenupt', is an agreement (contract) entered into prior to marriage to regulate how the parties are to hold their assets while they are married. This agreement also includes terms for the how assets are to be divided in the event of a divorce or break-up of marriage.

A prenuptial agreement is never made with the intention of getting divorced, however it is viewed as a responsible act before a marriage. Should your marriage come unstuck, such preparation can have a significant influence on a divorce settlement. However, currently prenuptial agreements are not strictly enforceable under England and Wales law.
