Collaborative family law was originally developed in the US and is a relatively new, practical approach to finding a mutually acceptable agreement in the event of family breakdown.
Each party, together with their family solicitor, begins the process by contracting not to go to court and to proceed with respectful and cooperative negotiation. Once a financial settlement has been reached, the family law solicitors draw up an agreement, which is submitted to the court for confirmation. Because collaborative family law is non-confrontational it is usually less stressful for everyone, as well as much cheaper than fighting a costly battle through the courts.
Arrangements with children often work out much better as well, as an agreement has been reached, rather than having been enforced upon.
