We were instructed by Mrs D, who resided in Spain. Her mother suffered from dementia and was in a care home in the UK. Our client's sister was the appointee for their parents.
Our client had concerns that her sister was not acting in their mother’s best interest, both in terms of financial and welfare decisions. We requested that the sister step down from her position as appointee, however she refused.
Therefore we made an application to the Court of Protection on behalf of our client to become Deputy for her mother. The application required a medical report and extensive detail on the affairs of the client’s mother. This was successful and our client was appointed Deputy for her mother, allowing her to make decisions for her mother in her best interest.
