Erb’s Palsy injury happens during the labour process due to the child’s head being subject to excessive force as the baby’s shoulder becomes lodged behind the mother’s pelvis, resulting in bruising and stretching. This is also referred to as ‘Shoulder Dystocia.’ Shoulder dystocia is a serious problem, which is often not foreseen and can result in severe injury or death to an infant. Once the baby’s head is delivered, the baby cannot breathe due to its chest and umbilical cord being compressed. The shoulders should be relaxed within six minutes otherwise there is a serious risk of brain damage.

It is often difficult to know what kind of injury has occurred and different injuries may cause the same symptoms. There are four types of brachial plexus injuries:

  1. Avulsion - the nerve is torn from the spine
  2. Rupture - the nerve is torn but not where it attaches to the spine
  3. Neuroma - occurs when scar tissue develops around the nerve as it heals resulting in reduction of signals to the muscles
  4. Praxis - occurs when the nerve is damaged, but not torn and heals on its own

Failure to carry out the necessary procedures will usually result in an Erb’s Palsy compensation claim.
