Clinical Negligence case report: £35,000 awarded as result
of faulty hernia operation
Our client underwent a bilateral hernia
operation in August 1997. He subsequently became very ill and it
was discovered that he had sustained a bilateral castration during
the operation due to the blood supply being compromised.
He suffered terrible sweats, loss of sexual
drive and his testicles were reduced in size by half. He requires
testosterone injections for the rest of his life.
The firm was initially instructed in December
1998, and an expert was instructed to prepare a report on the case.
The expert supported the case.
A Letter of Claim was sent to the Defendants'
insurers in April 2000, and they denied liability and causation.
However, it then subsequently transpired that the Defendants had
instructed the same expert and he had supported their case!
We instructed another expert and he reached
the same conclusion as the first expert. The Defendants also
instructed another expert and continued to strenuously defend the
claim.
Proceedings were issued in August 2001 and the
case was settled for £35,000.00 in February 2002.
