Clinical Negligence case report: £20,000 A v Hommerton Hospital NHS Trust

Our client was 28 years old at the time of her injuries, the case concerned the treatment she received during the birth of her baby in 2005.

Unfortunately, the doctors failed to correctly interpret the results of the relevant tracings during delivery. As a consequence they delayed the caesarean section and this meant that our client's baby did not survive.

Had the doctors delivered the baby by caesarean section at the correct time it is likely, on a balance of probabilities, that the baby would have been born alive.

The client was devastated by the events and suffered a moderate to severe psychological injury.

Legal Aid was granted to investigate the claim and after the medical records had been obtained, an expert was instructed.

The expert's report supported our client's claim and a Letter of Claim was sent to the Hospital explaining in detail the nature of the claim. At that stage the Defendant had 3 months within which to respond to the Letter of Claim.

The Defendant admitted liability in their Letter of Response. We put forward an offer to settle the claim on behalf of our client and kept her informed throughout the negotiations.

The Defendant agreed to an out of court settlement in favour of our client for the sum of £20,000 without the need to commence Court Proceedings.
