HJA issues proceedings in salmonella case
PRESS RELEASE - 19th November
2010
Salmonella poisoning case: Hodge Jones & Allen issues
proceedings on behalf of 165 Wandsworth clients
Hodge Jones & Allen solicitors are
representing
165 clients in a food poisoning case. In September 2009, the
clients suffered a personal injury in the form of negligent
exposure to the salmonella virus from egg sandwiches prepared by
the prison kitchen at HMP Wandsworth.
The Health Protection Agency prepared a report
in March 2010 which was critical of the method used to prepare the
egg sandwiches. Changes in kitchen procedure have changed as a
result.
Although breach of duty has been admitted no
settlement proposals have been put forward by the Ministry of
Justice. In light of this, proceedings have now been issued
in the High Court against the Ministry of Justice.
Personal injury
solicitor,
Simon O’Loughlin, a partner at Hodge Jones & Allen, who is
leading the case, commented: “There have been a number of
issues in this matter that have caused delay, including the change
of government. Notwithstanding these delays it was hoped that
this matter would have all been concluded by now. However
despite the admission of breach of duty from the Ministry of
Justice in July of this year all of the cases in the group action
still remain unresolved and we have been left with no choice but to
issue proceedings in the High Court. Hopefully the
involvement of the Court will now bring this matter to a conclusion
sooner rather than later.”
